.htaccess is missing in upgrade!

Ok, I just upgraded from gallery version 1.3.3 and followed the directions, but when I ran the config wizard it said :

"Serious Warning!

The following files are out of date, corrupted or missing:
    setup/.htaccess.

This should be fixed before proceeding
Look at Check Versions for more details."

I tried reuploading the setup directory and then also reuploading the version of it I'd saved from before the upgrade, but the error remained the same. When I clicked on the above, it said:

setup/.htaccess:
    File missing or unreadable.

the file didn't seem to be present when I went into the shell and looked inside the directory.

Help! I redownloaded the gallery file and reuploaded the setup directory again to try and fix this... I don't know what else to do!

PHP version (don't just say PHP 4, please): PHP v4.3.1

I just set up a gallery (last night as a matter of fact), using 1.4.1 - so I checked just now and there is an .htaccess file in the setup directory in the files I downloaded.

Maybe your download was corrupt? All I can think of is try downloading again and check to see what's in the setup folder.

I honestly had no difficulty at all, all the files were present and it took very little time to get things up and running.
