.htaccess file = 500, even with mods to httpd.conf - help?

If I delete the htaccess file, as noted in the FAQ I am able to go through most of the config. wizard. When I get the last step I get the error that I don't have an htaccess file[777] uploaded. As soon as I add one (the one I previously deleted from the main Gallery directory) I get a 500 error. My host appended my httpd.conf file for me and restarted apache with no problems. The htaccess file in the setup directory doesn't seem to be causing any problems but the main directory one does.
